Use of the tariff quota for the import of Ukrainian rolled metal products into the EU

The use of the quota within the framework of the final protective measure established by the European Commission in relation to rolled metal products originating from Ukraine and imported into the EU countries is analyzed.

The measures apply to 14 categories of Ukrainian metal products, of which 12 individual tariff quotas are applied, used on an annual basis, and 2 (group 1 and group 20) - global tariff quotas (i.e. first come - first served) used by quarterly principle. After the quota is exhausted, a protective 25% import duty begins.

In total, there are 3 periods (I - from 02/02/2019 to 06/30/2019; II - from 07/01/2019 to 06/30/2020; III - from 07/01/2020 to 06/30/2021) with a total duration of 10 quarters.

If a country chooses its own individual quota for a specific group, and in the last quarter of the current period (i.e., in the II, VI and X quarters) the volumes of the global tariff quota for the same group remain unselected, then such countries will be able to supply their products are already within the remaining global tariff quota without payment of protective duties.

Features of the global tariff quota:

- within one period, unselected volumes of the previous quarter are transferred to the next;

- quotas that were not selected at the end of the last quarter of the current period are not transferred into the subsequent period (“burn out”);

- the use of the volumes of the previous quarter will continue for another 20 working days of the next quarter (to ensure the "passage" of all unused volumes that were in the state of "waiting" at the end of the previous quarter);

- in case of “exhaustion” of the quarterly quota before the end of the quarter, for the period between the date of “exhaustion” of the quota and the beginning of the next quarter of the same period, the import duty of 25% is in effect;

Features of an individual tariff quota:

- unused by the end of the previous period, quota volumes in the subsequent period are not transferred (“burned out”);

- in case of "exhaustion" of the quota before the end of the current period, provided that there are no sufficient volumes of the corresponding global quota, for the period remaining until the beginning of the subsequent period, an import duty of 25% is applied.
