Sometimes in life there are situations when financial organizations demand the return of money that a person allegedly took. However, a person may hear for the first time that he has applied for an online microloan. What to do in such a situation?
To begin with, let's try to understand the concept of "microcredit" and how it can be obtained.
What is a microcredit?
Microcredit online on a card is a small amount of money that a non-bank organization lends for a short period of time (mainly up to 30 days). Such a micro-credit agreement is concluded with microfinance organizations. Today, most MFIs have their own websites, which means that you can apply for a microloan via the Internet without leaving your home. To do this, you need to fill out an online application on the MFI website, provide a photo or a copy of an identity document and enter the necessary information about yourself. Necessary actions upon detection of fraud
The process of applying for a microcredit on a card is short and simple, so scammers are increasingly using this method. If you find that an online microloan has been issued in your name, first of all, you need to find the microfinance organization in which the scammers took a microloan on you, and also find out how much it is. After that you need:
- contact the microfinance organization with the requirements to provide certified copies of the micro loan agreement, which contains the number, date of conclusion, details of the lender, as well as documents confirming that it was you who concluded the agreement. li>
- also, when contacting a microfinance organization, it must be emphasized that you personally did not conclude any micro-credit agreements with the MFO, did not receive money on the card (if necessary, provide the necessary evidence) and demand to cancel the considered you are indebted;
- In case of calls from employees of microfinance institutions or collection companies who will try to get you to pay off your debt, you must record all conversations. In the future, you can use this as evidence of the misconduct of such companies. Important! If the MFI has transferred the right to claim credit debt to a collection company, remember that no one has the right to enter your apartment or house without your permission (this is a criminal offense);
- Submit a criminal complaint against you to law enforcement, namely fraud.
- Submit a complaint about the conclusion of an online microloan agreement by an outsider in your name using fake documents to the National Bank of the Republic of Kazakhstan for verification and request clarifications from the MFI.
Nothing helps, what should I do?
If all of these actions did not lead to the desired result, you must apply to the court with an application to invalidate the loan agreement. During the consideration of the case, it will be necessary to provide evidence that you did not conclude an agreement, did not know about its existence, did not register on the MFI website and did not correspond with them.
You should also file a petition with the court demanding to obtain information from the mobile operator, whose number is indicated for obtaining a microcredit, the location of the mobile device by phone number and printout of SMS messages. You also need information from a banking institution on the card account to which the funds are transferred.
After the fraud is proven, you must contact the Credit Bureau with a request to remove the record of the disputed micro-credit debt from your credit history.
