ArcelorMittal Kryvyi Rih may sue the organizers of the strike

PJSC "ArcelorMittal Kryvyi Rih" respects the right of the company's employees to publicly express their point of view. The management of PJSC "ArcelorMittal Kryvyi Rih" considered the message about the strike of workers of the mine administration for underground ore mining (as mines) of the mining department of PJSC "ArcelorMittal Kryvyi Rih", scheduled for July 26, 2017. , is illegal, since during its organization the norms of the current legislation governing the procedure for resolving collective labor disputes (in particular, Article 22 of the Law of Ukraine "On the Procedure for Solving Collective Labor Disputes (Conflicts)") were violated. It should be noted that a decision on the conduct of the strike was not provided to the address of the enterprise, therefore it is impossible to assess its compliance with the procedure for adoption, provided for by the norms of the current legislation. In addition, at the moment, conciliation procedures have not been completed, which are a mandatory stage preceding the decision of employees to declare and conduct a strike.

PJSC "ArcelorMittal Kryvyi Rih" was untimely notified of the strike planning only 8 days before its start instead of 15 days stipulated by the legislation in the event of a strike at a continuously operating production facility. The interruption of work in the structural unit of the mining department, taking into account the specifics of the enterprise, may lead to the suspension of the production activity of the enterprise as a whole. At the same time, the created energy imbalance of the enterprise can lead to a full-scale man-made accident, which in turn will pose a threat to the life and health of residents of the city and the region.

In order to prevent the negative consequences of the unlawful decision of the persons who reported the organization of an illegal strike, PJSC "ArcelorMittal Kryvyi Rih" now uses all legal mechanisms provided for by the legislation of Ukraine to protect the interests of the enterprise and the labor collective, whose members may be misled by persons intending to conduct an illegal event.
