On October 2, the Verkhovna Rada adopted a draft law to improve the licensing of economic activities in Ukraine. The purpose of the bill is to simplify licensing procedures for the deregulation of economic activity. Thus, the bill introduces a new sanction for violation of licensing conditions - suspension of the license in full or in part. This type of sanction is defined as more effective than the complete cancellation of the license, since it gives the licensee the opportunity to correct the violations of the license conditions and then quickly restore the current license for its activities. At the same time, the bill establishes the procedure for the renewal of the license, which was stopped by the licensing authority, as well as the procedure for the licensee to appeal against the decision of the licensing authority to suspend the license.
It is also assumed that when re-submitting an application for a license, it will be necessary to add to the application only those documents that became the basis for the decision to refuse to consider it, provided that the documents in the licensing file were previously submitted, at the time of filing the repeated application they were saved its relevance.
In addition, the bill specifies that the revocation of a license can only be carried out in the event of serious violations or their repetition. Also, new conditions are introduced for the cancellation of the license - in case of recognition as incapacitated, partially incapacitated, recognition as missing, declaring the licensee dead; the presence of an act of non-elimination by the licensee during the period of suspension of the license of violations that served as the basis for its termination. At the same time, there will be solely grounds for revoking the license in case of non-payment by the licensee for the issuance of the license.
Moreover, the document proposes to unify the amount of fines for violation of legislation in the field of licensing, and also improves the procedures for appealing the actions of licensing authorities to the Expert and Appeal Council.
