US manufacturers lose on Canadian welded pipe duty increase

Many US manufacturers have been unable to continue their legitimate bid to raise US duties on large diameter welded pipes from Canada after they lost in court.

The contested administrative decision is a large diameter welded pipe from Canada: Final Affirmative Determination of Sub-Fair Sales, 84 FRS. Reg. 6378 (Int'l Trade Admin. February 27, 2019). The Commerce determined that the item under investigation, which was imported from Canada welded carbon and alloy steel pipe with a nominal diameter greater than 16 inches, “is or is likely to be sold in the United States at a price below fair value during the investigation period of 1 January 2017 to December 31, 2017 ". Id. In the course of the investigation, Commerce determined the estimated individual weighted average dumping margin of 12.32% for the respondent Evraz Inc., NA (Evraz), a Canadian exporter and manufacturer of the product, and adopted this margin as a rate.

The plaintiffs, domestic manufacturers of large diameter welded pipes, are American Cast Iron Pipe Foundry, Berg Steel Pipe Corp., Berg Spiral Pipe Corp., Dura-Bond Industries and Stupp Corporation, individually and as members of the American Pipeline Manufacturers Association.
